The Road Accident Fund (RAF) plays a vital role in ensuring the safety and well-being of South African road users. Through its commitment to providing cover, compensation, and rehabilitation to those injured in motor vehicle accidents, the RAF contributes significantly to social and financial protection in the country. The organisation also actively promotes safer road use to prevent accidents and loss of life.
Purpose of the Role
The RAF Attorney: High Court will be responsible for managing all High Court litigation matters on behalf of the Fund. This includes providing expert legal representation in court, overseeing litigation processes, drafting legal documents, and offering sound legal advice. The role also encompasses tax-related services, including taxation of bills of costs, ensuring compliance with South African laws and regulations.
This is a strategic and specialised role requiring in-depth legal knowledge, strong litigation skills, and a thorough understanding of personal injury law and the operations of the RAF.
Key Responsibilities
1. Policy Review and Implementation

Contribute to developing and implementing departmental policies, procedures, and processes

Stay updated on legal policies, practices, and litigation strategies to ensure compliance and efficiency
2. Preparation and Research on Litigation Matters

Conduct in-depth legal research for trial preparation

Consult with client departments, witnesses, and stakeholders to gather instructions and documentation

Draft legal pleadings to clearly outline RAF’s position in litigation
3. Mediation Process
-
Execute all required steps in accordance with the amended rules of court regarding mediation
-
Upon completion of mediation, ensure timely communication with the Registrar and all relevant parties
-
Prepare and issue joint minutes within 5 days of mediation conclusion
4. Representation in High Court Litigation
-
Represent the RAF in all third-party claims and litigation matters
-
Attend court appearances, hearings, and trials
-
Oversee full case file administration from inception to conclusion
-
Manage administrative legal actions to ensure legal compliance
-
Approve the appointment and instruction of expert witnesses
5. Settlement of Non-Litigious Matters
-
Conduct early file assessments and consultations to facilitate early settlement where possible
-
Approve the appointment of assessors and expert witnesses
-
Recommend settlements to avoid unnecessary litigation
6. Provision of Legal Advice
-
Provide well-researched legal opinions and advice on matters impacting the RAF
-
Guide internal stakeholders on legal aspects of contracts and operational decisions
7. Taxation
-
Deliver a full range of tax services in compliance with applicable laws

Build relationships with clients to provide consulting and tax expertise

Provide tax planning and review of complex income tax returns
8. Reporting

Prepare and submit regulatory reports as required

Develop and maintain functional reporting systems for management, performance, and compliance

Draft proposals, reports, and presentations to support strategic decision-making
9. Stakeholder Management

Build and maintain positive relationships with internal and external stakeholders

Oversee vendor and service provider relationships, ensuring timely invoicing and payments

Communicate effectively at all stakeholder levels
10. People Management

Recruit, develop, and retain a high-performance legal team

Manage human capital processes to ensure team alignment with RAF strategic objectives

Provide coaching, mentoring, and performance evaluations
-
Motivate and direct staff to achieve departmental goals
Minimum Requirements
Qualifications
-
Bachelor’s Degree in Law or equivalent
-
Postgraduate qualification in Law or equivalent
-
Admission as an Attorney of the High Court or Advocate
-
Right of appearance in the High Court
Experience
-
5-7 years post-graduation or post-admission legal experience
-
At least 2 years specialised experience in personal injury litigation
